El Estado es un concepto clave en la filosofía jurídico-política de José Ortega y Gasset (Madrid, 1883-1955). Sin embargo, resulta sorprendente que, pese a la importancia que para este autor tenía dicha noción, no haya sido estudiada con la misma profundidad e interés que otras vertientes de su pensamiento. A este respecto, basta repasar las monografías y los artículos publicados hasta la fecha sobre la figura y la obra de Ortega para constatar que, en términos cuantitativos, las investigaciones (...) dedicadas a la idea orteguiana del Estado han sido apenas testimoniales, y desde luego no son tan significativas como las que se han podido dedicar a otros temas o tópicos más conocidos de su pensamiento. Así pues, el presente libro pretende abordar el estudio de la realidad problemática del Estado en su triple dimensión histórica, sociológica y política. De acuerdo con tal propósito, esta monografía se divide en tres partes: en la primera de ellas, se estudian las instituciones políticas de Roma entendidas por Ortega como precedentes ineludibles para la formación histórica del Estado. La segunda parte de la obra versa sobre el Estado concebido como culminación de lo social, es decir, como órgano diferenciado para el ejercicio del poder público, lo cual conduce indefectiblemente hasta la Teoría de los usos sociales. Por último, la tercera parte se centra en el concepto orteguiano de Estado como forma de organización política, explica la relación que mantienen el Estado y nación en su obra, y expone las líneas principales del programa político pensado por Ortega para modernizar, regenerar y europeizar a España. Nocebo effects occur when an individual experiences undesirable physiological reactions caused by doxastic states that are not a treatment’s core or characteristic features.1 As Scott Gelfand2 points out, there are numerous studies that have shown that the disclosure of a treatment’s side effects to a patient increases the risk of the side effects. From an ethical point of view, nocebo effects caused by the disclosures of side effects present a challenging problem. On the one hand, clinicians’ duty to inform patients (...) of the consequences (including possible side effects) of their treatments is critical in ensuring that patients’ autonomy is respected. Patients cannot act autonomously if relevant information is withheld from them (without their consent, perhaps). On the other hand, clinicians also ought to minimize harm to patients. (shrink)

Rhees seems unaware that Simone Weil differed from him both in her conception of philosophy and of its relation to religion. She differed also in her view of the relation between religion and science. On her view, the aim of science is to find the laws which will allow us to apply deductive reasoning to nature. The necessities revealed had for her a religious significance. But this can be understood only given her view of the relation between God and the (...) world. On her view, the creation of the world did not involve an extension of God's power. It involved a withdrawal of his power, so that there could be an existence independent of himself. God does not interfere in the details of the world but sustains it through a network of necessities. For this reason, these necessities can serve as a sign of God. (shrink)

This edited collection presents the case for a research program (in Lakatos's sense) in the social sciences based on the theory of recognition developed by Axel Honneth and others in recent years. The cumulative argument of the book is that recognition theory provides both a plausible framework for explaining social conflict and a normative compass for reaching just resolutions.

In recent times Wittgenstein's work in logic has had an influence on other branches of philosophy. I am thinking, in particular, of social philosophy and the philosophy of religion. In these branches, Wittgenstein's followers have made much use of his notion of a language game. It has been argued, for example, that religion forms a language game of its own, having its own standards of reason, and is therefore not subject to criticism from outside. This argument has given rise to (...) controversy, some seeing it as a subtle attempt by the religious to evade criticism. I have come myself to feel that the notion of a language game has been put to uses with which Wittgenstein himself might not have agreed, or, if he had, would have been wrong to do so. In order to explain what I mean I should like to look closely at the opening section of Peter Winch's article ‘Understanding a Primitive Society’. (shrink)

ABSTRACT A number of philosophers have argued that alcoholics should receive lower priority for liver transplantations because they are morally responsible for their medical conditions. In this paper, I argue that this conclusion is false. Moral responsibility should not be used as a criterion for the allocation of medical resources. The reason I advance goes further than the technical problem of assessing moral responsibility. The deeper problem is that using moral responsibility as an allocation criterion undermines the functioning of medicine.

In the last five years, a number of U.S. companies have either moved their locus of incorporation to countries with more favorable tax laws, or announced such moves. Given this trend toward “inversions”, and the polemics that have accompanied it, we offer two ways in which the ethics of such a move can be evaluated. We provide multinational executives with two applications of ethics to inversion: Kant’s deontological theory and the consequentialist perspective of utilitarianism.

What is the fundamental purpose that justifies the existence of the modern university? The answer proposed in this essay is the promotion of social freedom. The essay begins by distinguishing social freedom from negative freedom and reflective freedom along the lines proposed by other theorists of social freedom, such as Frederick Neuhouser and Axel Honneth. After noting the need for a more developed account of the university than has so far been provided by these other theorists, the essay analyses the (...) various dimensions in which universities have, at their best, promoted social freedom. The essay then explains why it is through the promotion of social, as distinct from negative or reflective freedom, that universities fulfil their purpose. It concludes with some reflections on how this understanding of the purpose of the university fits an “immanent” model of social criticism. (shrink)

When scientists consider the interaction of science and value judgments, debates often occur. When public policy grows out of science, disagreements between scientists can become even more spirited. This paper examines the case of nutrition policy in the United States, which has been both at the interface between agriculture and medicine and the object of serious discord concerned with the strength and validity of the scientific evidence and the responsibility for action. The development of indirect intervention policies, designed to educate (...) and inform the public on diet and health, is traced as a practical demonstration of the effects of involvements of nutritional scientists of different disciplines and philosophic bents. Controversies centered mainly on the issues of diet and coronary heart disease and of diet and cancer in nutritional guidelines for Americans and the recommended dietary allowances. But the arguments turned on a complex web of values and interests as well as scientific questions. A remarkable turnaround by animal agriculture and its scientific support occurred, changing from a defensive, rightist stance to one that appears to recognize a moral responsibility to the public health. The convincing point was likely the changing market. Nutritional scientists, however, remained divided on the issue of whether a public health strategy keyed to public education should replace a strategy to identify persons of high risk and modify the risk by treatment. Our analysis suggests that the tension between libertarian and utilitarian social values of scientists is at least as important as disagreements relative to validity and strengths of the scientific evidence. This essay examines the growing concerns about disciplinary narrowing occurring in agricultural research and the prospects of ameliorating the detrimental effects of disciplinary compartmentalization while capitalizing on its positive effects. The general model for agricultural science is that disciplinary groupings set the logic and standards for research; the disciplinary sciences are set in a hierarchical arrangement which allows communication from the relevant basic sciences through applied research into technology development and use and problem-solving. But agricultural research throughout most of its (...) history has been goal-oriented and, therefore, is subject to ethical judgements of its worth and consequences. Also, strategic aspects of agricultural research have been subject to the evaluations and criticisms of both scientists and critics with differing interests at stake. Goals can change and organizations can be set to enable multidisciplinary and interdisciplinary research, but both goals and organizations come up against values associated with the disciplinary quality of the research, the social setting of academic science, the competition for resources, and the scientific reward system. However, there are changes underway in the agricultural scientific community which may recast the impacts of disciplinary structuring: (1) changes in the disciplinary components of subject areas and departments, (2) evolution and introductions of integrative and systems sciences into the system, (3) infusion of the same new powerful tools into most of the sciences, and (4) increased networking among scientists of different disciplines. Given that scientists' values and personalities intrude in agricultural science and research strategies, the future of agricultural research may rest on the scientists' intellectual vision and philosophical awareness that go beyond the expected disciplinary limits. We are dealing with the Dirac Hamiltonian H = H0 + V with no magnetic field and radially symmetric electrostatic potential V = V(r), preferably the Coulomb potential. While the observable H is precisely predictable, its components H0 (relativistic mass) and V (potential energy) are not. However they both possess precisely predictable approximations H0 ∼ and V∼ which approximate accurately if the particle is not near its nucleus. On the other hand, near 0, H0 and V are practically unpredictable, perhaps (...) in agreement with the fact, that a neutrino also should be in the game. [We have not yet studied the corresponding observables for the (≥ 12-dimensional) problem of electro-weak interaction.] Mathematically we are focusing on the spectral theory of the unbounded self-adjoint operators H0 ∼ and V ∼. We can prove that V ∼ is unitarily equivalent to V(r) again, by a unitary map given as Wiener-Hopf-type singular integral operator in the standard separation of variables for radially symmetric Dirac Hamiltonians. [This is, as far as the continuous spectrum is concerned.] Very similar unitary equivalence holds for H 0 ∼ and H 0. We are tempted to regard this as a form of “renormalization”. (shrink)

Hume is not a philosopher who has been viewed, on the whole, with excessive sympathy. Slips and inadequacies of argument, which are the inevitable consequence of human fallibility, are treated by his critics not with charity but with delight; and there are few who think it necessary to state his argument at its strongest before proceeding to refute it. A striking example of this procedure may be found in Antony Flew's paper ‘Another Idea of Necessary Connection’. The example is striking (...) because Flew is normally one of the most sympathetic of Hume's critics and he might have been expected, in dealing with Humes view of causal necessity, to have proceeded with exceptional fairness, the incidental being identified and discarded and the essential view standing forth at its strongest. This, as I shall show, is not what occurs; but first let us consider what we are to take the essential view to be. (shrink)

In 1954 F. R. Leavis wrote to the Times Literary Supplement taking issue with one of its reviewers. The reviewer had contrasted Leavis's approach to Shakespeare with that of Empson and Bradley. The latter, the reviewer had said, ‘like the plain man, or the audience in a theatre, cannot help considering the situation [in one of Shakespeare's plays] as “actual” and the characters as “real”’. Leavis, the reviewer had implied, treats the situation and characters somewhat differently.
